Protect Your PC – Digital Client Consent Form

Effective Date: 07/12/2025

Before Protect Your PC can provide any Services, including remote IT support, malware/virus removal, cybersecurity support, software installation (including ESET), or related services, you must read, understand, and electronically acknowledge this Digital Client Consent Form.

This form consolidates and references the following client documents:

  • Website Terms of Use and Online Resource Access

  • Privacy Policy

  • Terms of Service

  • Client Disclaimer & Liability Waiver

  • Client Services & Remote Access Agreement

  • Any other current or future client-facing documents

Service cannot proceed until this form is fully completed and submitted.

1. Client Acknowledgement and Consent

By completing this form, you confirm and agree that:

1.1 You have read, understood, and accepted all the documents listed above.

1.2 You are the legal owner or authorised representative of the device(s) to be serviced.

1.3 You consent to Protect Your PC performing all requested services, including:

  • Remote access

  • Installation, configuration, and troubleshooting of software

  • Malware, virus, ransomware, or spyware removal

  • Cybersecurity guidance, auditing, and consulting

1.4 You understand and accept the risks and limitations of the services, including but not limited to:

  • Possible data loss, corruption, or system instability

  • Limitations of malware/virus removal

  • No guarantee of 100% protection from cyber threats

1.5 You acknowledge and accept your responsibilities, including:

  • Maintaining up-to-date backups of all data

  • Licensing, updating, and compliance for third-party software (including ESET)

  • Following cybersecurity guidance after the service

  • Device maintenance, security, and ongoing system functionality

1.6 You understand and accept that Protect Your PC’s liability is limited as described in the Client Disclaimer & Liability Waiver, except for statutory rights under the Australian Consumer Law (ACL).

1.7 You acknowledge that services will not commence until this form is completed and submitted, and that your electronic submission constitutes a legally binding record of consent.

2. Remote Access Authorisation

2.1 By signing this form, you authorise Protect Your PC to access your device(s) remotely for the purposes of providing Services.

2.2 You understand that:

  • Remote access may involve temporary control of your device by Protect Your PC personnel

  • You may monitor or terminate access at any time

  • Protect Your PC is not responsible for any pre-existing faults or unrelated issues that arise during remote access

3. Third-Party Software

3.1 You acknowledge that any third-party software installed (including antivirus/security solutions such as ESET) is subject to its own licensing terms and warranties.

3.2 You accept responsibility for:

  • Licensing, renewals, and compliance

  • Addressing any disputes or technical issues directly with the software provider

3.3 Protect Your PC cannot guarantee long-term performance, compatibility, or effectiveness of third-party software.

4. Indemnity

By completing this form, you agree to indemnify, defend, and hold harmless Protect Your PC, its owners, employees, contractors, and affiliates from any claims, losses, damages, liabilities, or expenses (including reasonable legal costs) arising from:

  • Misuse, negligence, or modification of your device, software, or systems

  • Breach of this Consent Form or applicable laws

  • Unauthorised use, copying, or distribution of third-party software

  • Failure to follow advice, instructions, or cybersecurity guidance provided

5. Hierarchy and Severability

5.1 This Consent Form operates in conjunction with all other Protect Your PC client documents.

5.2 If any provision of this Consent Form is found unenforceable, it will be severed without affecting the enforceability of remaining provisions.

5.3 Where inconsistencies exist between documents, the provision giving greatest legal protection to Protect Your PC shall apply, to the extent permitted by law.
