Protect Your PC – Client Services & Remote Access Agreement

This Client Services & Remote Access Agreement (“Agreement”) forms a legally binding contract between Protect Your PC (“we”, “us”, “our”) and you (“the Client”, “you”, “your”) for IT services, cybersecurity support, software installation (including ESET), virus removal, remote troubleshooting, or any other work requested by you.
This Agreement applies to all services, whether delivered remotely, on-site, or via digital methods.
1. Consent to Services
By requesting or allowing services to begin, you consent to:
1.1 Performance of IT support, malware removal, software installation, troubleshooting, system configuration, cybersecurity work, or any task described in your service request.
1.2 Use of remote access tools where required.
1.3 Installation, configuration, removal, updating, or optimisation of software or system settings on your device(s).
1.4 Use of third-party software essential to the service, including ESET products.
2. Remote Access Authorisation & Informed Consent
2.1 You authorise us to remotely access your device(s) using secure, encrypted tools such as RustDesk, Zoom, Microsoft Teams, ESET tools, or other approved platforms.
2.2 Remote access is strictly limited to:
Malware, virus, ransomware, or spyware detection and removal
Installation, configuration, or updating of antivirus/security software (e.g., ESET)
System troubleshooting, optimisation, or configuration
Software installation, updates, or configuration as requested
2.3 You may monitor, revoke, or terminate the session at any time.
2.4 We will not intentionally access, modify, view, delete, or copy personal files unless necessary to complete the service or with your explicit consent.
2.5 Remote access is temporary and ends when the session is closed.
2.6 Remote access may not be possible in the event of network failure, hardware faults, or device inoperability.
2.7 You understand that remote access is provided on a best-effort basis; issue resolution cannot be guaranteed.
3. Client Responsibilities
3.1 You are the legal owner or authorised representative of the device(s) being serviced.
3.2 You have backed up all important data prior to service commencement. Protect Your PC accepts no liability for data loss if data is not backed up, except as required under the Australian Consumer Law (ACL).
3.3 You will follow instructions provided by our technicians during the session.
3.4 You will provide accurate and complete information about the issue.
3.5 You hold all relevant software licences and authorisations.
3.6 Cybersecurity and device maintenance remain your responsibility after service completion.
4. Inherent Risks and Limitations
4.1 You acknowledge that IT services and remote access involve inherent risks, including but not limited to:
Data loss, corruption, or alteration
System instability or unavoidable restarts
Incomplete malware removal
Issues arising from pre-existing faults or outdated hardware/software
4.2 Malware may reappear due to user actions, external threats, expired software, or vulnerabilities beyond our control.
4.3 No service, IT support, or antivirus software (including ESET) can guarantee 100% protection from viruses, malware, hacking, or cyber-attacks.
5. Third-Party Software & Licensing (Including ESET)
5.1 ESET products are developed and maintained by ESET, not by Protect Your PC.
5.2 We are authorised ESET partners but not the software manufacturer and do not guarantee future compatibility, performance, or effectiveness.
5.3 You are responsible for:
Renewing licences before expiry
Maintaining valid licensing
Compliance with third-party software terms
5.4 Any technical faults or warranty issues must be raised directly with the software provider.
6. Fees, Payment, and Refunds
6.1 Fees are payable upon completion of the service unless otherwise agreed.
6.2 Refunds are provided only as required under the ACL.
6.3 If the service cannot be completed due to faults outside our control, a call-out or diagnostic fee may still apply.
7. Liability Waiver
To the fullest extent permitted by law:
7.1 Protect Your PC is not liable for:
Data loss, corruption, or damage
Software or hardware failure
Loss of income, productivity, or business
Indirect, special, or consequential damages
Issues caused by malware, user error, or third-party software
7.2 Our total liability is limited to the amount paid for the specific service.
7.3 Nothing in this Agreement excludes your statutory rights under the ACL.
8. Privacy and Confidentiality
8.1 Remote sessions use secure, encrypted technology.
8.2 We do not permanently store or retain your passwords, login credentials, or personal files.
8.3 Personal information is handled in accordance with our Privacy Policy and Australian privacy laws.
8.4 We will never sell, misuse, or disclose your information except where required by law.

9.2 Where inconsistencies arise, the document providing greater legal protection to Protect Your PC applies, to the extent permitted by law.
9.3 Additional terms may apply to specific services, downloads, or client engagements. Where applicable, those terms operate alongside this Agreement.
10. Confirmation of Consent
By requesting or allowing services to begin, you confirm that:
You provide full consent to the service and remote access
You understand and accept all risks
You agree to all terms in this Agreement and related policies
You accept the limitations of liability under Section 7
You acknowledge remote access is provided on a best-effort basis
11. Governing Law and Contact
11.1 This Agreement is governed by the laws of the Australian State or Territory in which you reside or conduct business.
11.2 Any disputes will be resolved according to applicable laws.
